1. Acceptance of these terms
By accessing or using americansporteducation.com (the “Site”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.
2. About the Site
American Sport Education (“ASE,” “we,” “us,” or “our”) provides information, member accounts, course enrollment records, and services related to sport education, professional development, and credentialing. Some programs or features may be planned, limited, or not yet available.
3. Eligibility
You must be at least 13 years old to use the Site. If you are under the age of legal majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.
3A. Accounts and enrollment
You must provide accurate, current information and protect access to your account. You are responsible for activity under your account and must notify us if you suspect unauthorized access. You may not impersonate another person or create an account for someone else without authority.
Submitting an online enrollment records your registration for the selected course. It does not by itself guarantee admission, course availability, scheduling, certification, professional licensure, or a particular outcome. Program-specific requirements, assessments, fees, refund terms, and credential rules presented separately also apply.
4. Certification and educational information
Descriptions of certifications, courses, pathways, eligibility requirements, learning outcomes, pricing, availability, and schedules may change. An online enrollment does not confer a credential, guarantee eligibility, or create a professional license. A credential is awarded only after applicable requirements are satisfied and verified.
Site content is educational and general in nature. It is not legal, medical, financial, safeguarding, employment, or other professional advice.
5. Permitted use
You may access and use the Site for lawful, personal, educational, or internal organizational purposes. You agree not to:
- Use the Site in violation of any law or the rights of another person;
- Attempt to gain unauthorized access to the Site, accounts, systems, or networks;
- Interfere with the Site’s operation, security, or availability;
- Introduce malicious code, scrape the Site in a manner that creates an unreasonable burden, or use automated means to circumvent access controls;
- Misrepresent your identity, affiliation, qualifications, or ASE credential status; or
- Copy, alter, sell, sublicense, or exploit Site content except as allowed by law or with our written permission.
6. Intellectual property
The Site and its text, design, graphics, logos, badges, certification names, photographs, downloads, and other content are owned by or licensed to ASE and are protected by applicable intellectual-property laws. No license to use ASE names, logos, badges, or credential marks is granted except through an express written agreement or applicable credential-use policy.
7. Communications
If you contact us by email, you agree that we may respond electronically. Do not send sensitive personal, financial, health, or confidential information through ordinary email unless we specifically request it through an appropriate secure process.
8. Third-party links and resources
The Site may link to third-party websites or resources for convenience. We do not control and are not responsible for their content, availability, security, products, services, or privacy practices. A link does not imply endorsement.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” ASE disclaims all express and implied warranties, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, availability, and security. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the fullest extent permitted by law, ASE and its officers, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, opportunities, goodwill, or reputation arising from or related to the Site. Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so portions of this section may not apply to you.
11. Changes and availability
We may update, suspend, withdraw, or change the Site, its content, and these Terms at any time. Updated Terms will be posted here with a revised effective date. Your continued use after an update means you accept the revised Terms.
12. Governing principles
These Terms are governed by applicable laws of the United States and the laws applicable where ASE is established, without regard to conflict-of-law principles. Nothing in these Terms limits non-waivable consumer rights. If any provision is found unenforceable, the remaining provisions will remain in effect.
